One of the first and most crucial questions when considering a name change for a child is: who needs to consent? The legal principle of parental responsibility is central to this. In the UK, parental responsibility refers to the rights, duties, powers, responsibilities, and authority a parent has in relation to a child and their property.
Generally, anyone with parental responsibility for a child must consent to a change of name. This typically includes:
- The Mother: Unless a court order states otherwise, the mother automatically has parental responsibility from birth.
- The Father: If the parents were married when the child was born, the father automatically has parental responsibility. If they were not married, the father usually acquires parental responsibility if his name is on the birth certificate (for births after December 1, 2003 in England and Wales, after April 15, 2002 in Northern Ireland, and after May 4, 2006 in Scotland) or if he has obtained a Parental Responsibility Order from the court, married the mother subsequently, or entered into a Parental Responsibility Agreement with the mother.
- Step-Parents and Guardians: In some cases, step-parents or legal guardians may also have parental responsibility granted by a court order.
The Requirement for Consent:
For a child's name to be legally changed via Deed Poll (when all parties agree), the consent of everyone holding parental responsibility is usually required. If one parent does not consent, or if their whereabouts are unknown, you cannot simply execute a Deed Poll and change the child's name.
What Happens if Consent Isn't Given?
If you wish to change your child's name and do not have the consent of everyone with parental responsibility, you will likely need to apply to the court for a Specific Issue Order. This order, under the Children Act 1989, allows the court to make a decision on a specific aspect of a child's upbringing, such as a change of name. The court's paramount consideration will be the child's best interests.
